Affidavit to be submitted to Passport Authority

This affidavit is required by an individual when he has applied for a passport and wishes to submit certain facts to the passport authorities. AFFIDAVIT is a formal written statement or declaration of certain facts made voluntarily on oath and signed in the presence of someone legally authorized to administer an oath, such as a notary public, oath commissioner, judges in the court, it is intended to be used as a proof in the courts or submitted in original with the concerned authorities who may fear for their safety. The person making the statement is called Deponent or Affiant. This affidavit is required by an individual when he has applied for a passport and wishes to submit certain facts to the passport authorities.

Can two persons execute an affidavit jointly?

Ans.

Yes, two or more persons can execute an affidavit jointly subject to the conditions that each should dispose separately the facts which are within his own knowledge, and such facts should be stated in separate paragraphs.

What are the consequences of filing a false affidavit?

Ans.

Giving a false affidavit is a punishable offence and the criminal proceedings can be initiated against the deponent/affiant. If the false affidavit has been filed in the court proceedings, it amounts to contempt of court for which deponent/affiant can be prosecuted and punished.

Can affidavits be used as evidence under Evidence Act?

Ans.

No, affidavits cannot be used as evidence under Evidence Act as they do not comply with the requirements of law as the major part of it.

Does the form for Affidavit of Support need to be notarized?

Ans.

No, the sponsor must only sign the form. However, by signing an Affidavit of Support the sponsor certifies under penalty of perjury that the information and supporting documents provided are true and correct.

Who attests the affidavits?

Ans.

Affidavit can be attested by the Executive Magistrate.

Who can make an Affidavit?

Ans.

There is no requirement related to the age of the person making an affidavit. The following persons can make an affidavit:
1. Person with required mental capability for taking an oath
2. Person with enough knowledge of disputed facts
3. Person familiar with the applicable matter
4. Guardian for a minor
5. Attorney for a client
6. Personal representative or an agent

If you have facility of franking for Stamp Duty payment at nearest bank, you need to print the Agreement & get franking done. If you wish to have 2 copies of Agreement you should frank 2 copies (one copy for each party)

Photographs & Signatures/ Thumb Impression & Initials:

The concerned parties should sign, affix their mark and recent passport size photographs against their names on the last page of the document.

Witness Attestation (Both Parties):

Must be signed by the party (deponent) & the advocate identifying him.

 

 

 

STEP 8

Registration/ Notary
